About the position

Work environment
The Department of Justice Canada is recruiting experienced counsel from the private sector to work on some of the Government of Canada’s most challenging and high priority files. We are seeking interest from seasoned corporate/commercial, financial, real estate and aboriginal law counsel to support complex, high value initiatives that directly affect Canada’s sovereignty, national security, natural resource and energy, infrastructure and housing priorities.
Intent of the process
A pool of qualified candidates may be established from this inventory which may be used to staff similar positions (term or indeterminate) within the Department of Justice (including our Legal Services Units located in various government departments). Candidates may be required to meet asset qualifications, organizational needs or other qualifications specific to the position being staffed that may or may not be listed in this job advertisement.

1) Corporate / Commercial Law Opportunities:
Justice Canada is enhancing its corporate-commercial practice and capacity to meet an anticipated increase in workload and to respond to new and evolving Government of Canada priorities. Specifically, Justice Canada is seeking counsel in the following areas:
o Marine and Defense Procurement Law Team
o Transportation and Infrastructure
o Natural Resources and Energy
o IT procurement law opportunities
2) Real Estate Law Opportunities
Justice Canada is also seeking experienced real estate counsel to strengthen its Real Property Law Team.
3) Aboriginal law Opportunities:
Justice Canada is also seeking interest from counsel to advise the government on Aboriginal law and Indigenous rights matters as well as being part of litigation teams working on related challenges. The legal work would include a broad range of subjects including Aboriginal and treaty rights, honour of the crown, work on major national resource projects, claims and assertions, requirements and implications of the Crown’s duty to consult as well as the United Nations Declaration on the Rights of Indigenous Peoples Act.

These roles offer private sector counsel the opportunity to apply their transactional and advisory skills to files of national significance, with a clear public interest dimension and tangible impact for Canadians.

Conditions of employment

SECURITY CLEARANCE:
Reliability, Secret, or Top Secret security clearance (depending on position or as required).
LICENSE:
Remain a member in good standing of a Law Society of a province or territory of Canada or in the Chambre des notaires du Québec.

Operational Requirements

o Willing and able to work extended hours including weekends.

OCCUPATIONAL CERTIFICATION:
Eligibility for membership in the Bar of one of the provinces or territories of Canada or in the Order of Notaries in the Province of Quebec
EXPERIENCE:
Significant experience* providing legal services as counsel in at least one of the following areas:
o Corporate or commercial law
o Specialized real estate, including complex real estate transactions and acquisition and disposition of multi-million-dollar properties
o Aboriginal law\Indigenous rights
* Significant experience providing legal services as counsel is defined as the depth and breadth of experience normally associated with performance of the duties working on legal and/or legal policy matters as counsel over a period of approximately four (4) years.

ASSET EXPERIENCE:
o Experience of corporate or commercial law with complex transactions and deal structures
o Experience of corporate or commercial law with investment instruments such as loans, advances, guarantees and equity, infrastructure development practice, including strategic and structuring advice, negotiation and drafting.
o Experience of corporate or commercial law with natural resource or energy sector-specific expertise, as well as some knowledge of the interplay of financial considerations with Indigenous and regulatory considerations.
o Experience of corporate or commercial law with IT and procurement law, including drafting and negotiating complex IT contracts, Cybersecurity and incident response with experience in technology procurements and knowledge of emerging technology (AI, automation, cybersecurity)
o Experience in commercial leasing, including negotiation and drafting of leases and leasehold improvement agreements
o Experience on complex major projects or in litigation on Aboriginal law matters
o Approximately five (5) years of experience in one of the following areas of law:
• corporate or commercial law with complex transactions and deal structures
• corporate or commercial law with investment instruments such as loans, advances, guarantees and equity, infrastructure development practice, including strategic and structuring advice, negotiation and drafting
• corporate or commercial law with natural resource or energy sector-specific expertise, as well as some knowledge of the interplay of financial considerations with Indigenous and regulatory considerations.
• corporate or commercial law with IT and procurement law, including drafting and negotiating complex IT contracts, Cybersecurity and incident response with experience in technology procurements and knowledge of emerging technology (AI, automation, cybersecurity)
