Duties

The Treasury Board Secretariat (TBS) is the administrative arm of the Treasury Board consisting of 6 Deputy Ministers: the Secretary of the Treasury Board, the Associate Secretary, the Chief Human Resources Officer of Canada, the Associate Chief Human Resources Officer of Canada, the Chief Information Officer of Canada, and the Comptroller General of Canada. As a central agency TBS is leading from the front and taking a leadership role in fostering a respectful, safe and inclusive workplace.

The Legal Services Branch provides strategic legal advice to the Treasury Board in its roles as employer, budget office and management board of the Government Canada, as well as to the President of Treasury Board, the Secretariat, and the Canada School of Public Service. It is also responsible for representing the Treasury Board as employer for the core public administration and separate agencies and deputy heads before specialized tribunals and courts of law.

Intent of the process

Stream 1 - Litigation
Stream 2 - Advisory

The initial intent of this process is to offer one indeterminate appointment.

A pool of qualified persons resulting from this process may be created and may be used to fill similar positions within Treasury Board Secretariat with similar linguistic profiles (English Essential, Bilingual Imperative BBB/BBB, Bilingual Imperative CBC/CBC) as well as tenures (indeterminate, deployment, acting, assignment, secondment, specified period) which may vary according to the position being staffed.

In order to be considered, your application must clearly explain how you meet the following (essential qualifications)

Education:

Successful completion of two years of a post-secondary program with acceptable specialization in a law related field from a recognized institution OR an acceptable combination of education, training and/or experience.

Degree equivalency

Experience - Both Streams:

- Significant* experience in conducting a wide range of paralegal activities, with full autonomy, in the context of advisory or litigation work.
- Experience conducting substantive legal research and analysis on legal issues well established in law such as preparing summaries and recommendations for counsel.
- Experience in preparing and updating a variety of legal reports.

*Significant is defined as depth and breadth of experience normally associated with the performance of those duties for a period of three (3) years.

Stream 1 - Litigation:

- Experience assisting counsel in the preparation of cases for litigation, including drafting and formatting legal documents such as pleadings, motions, affidavits, facta, records, bills of cost, demand letters as well as preparing books of documents and jurisprudence.
- Experience gathering, organizing and preparing large volumes of legal documents and information, including reviewing documents for relevancy and privilege.
- Experience serving and filing court documents with a board, tribunal or the courts.

Stream 2 – Advisory:

- Experience assisting counsel in an advisory capacity including drafting summaries and formulating recommendations to support legal opinions.

Knowledge - Both Streams:

- Knowledge of Federal or Civil courts rules and procedures as it relates to the Federal Courts and applicable provincial superior courts.
- Knowledge of the Access to Information Act, Privacy Act and related policies, directives and regulations.

Ability to plan and organize workload to manage multiple priorities and deliver results within deadlines.

ASSET CRITERIA

Education:

Paralegal certificate, paralegal license or graduation from a recognized university with a degree in a field relevant to the work to be performed.

Degree equivalency

Experience:

- Experience presenting before the courts, administrative tribunals or quasi-judicial boards on litigation matters, including motions and prehearing conferences.
- Experience with Litigation holds, including the implementation of Litigation Hold Notices and the coordination of document collections.
- Experience in the interpretation and application of the Access to Information Act or the Privacy Act for the purpose of responding to ATIP requests by reviewing documents, applying exclusions and exemptions as well as making recommendations.
- Experience in preparing contingent liability reports.

Knowledge:

Knowledge of legal information management systems. (ex: LEX, Justipedia)

Operational Requirement(s):

Ability to work overtime with little notice on occasion.
