Duties

The Conduct Adjudications Directorate (CAD) is responsible for conduct hearings and the adjudication of certain types of appeals under Part IV of the Royal Canadian Mounted Police Act, R.S.C., 1985, c.R-10. Conduct Hearing Officers are accountable for chairing conduct hearings and rendering adjudication decisions related to serious misconduct cases of RCMP Members, as well as for adjudicating specific appeals at the final level of the RCMP conduct process. The CAD is comprised of a Director, Conduct Hearing Officers (who serve as Conduct Boards), legal counsel, Registrar, Editor and administrative support staff. Conduct Hearing Officers report to the Director General, Recourse Services Branch.

The Recourse Appeals and Review Branch (RARB) is responsible for the adjudication of Final Level Grievances and Appeals falling under the Commissioner’s authority. The RARB is comprised the Director General, Adjudicators, Registrar and Editor. Counsel will report to the Director General of the RARB.

The positions are located in the National Capital Region. Full-time remote work for candidates outside the NCR but within Canada may be considered in accordance with organizational needs.

Our team is located at 73 Leikin Drive in Ottawa, Ontario (Barrhaven), in a modern building with plenty of free parking, and convenient access to bus routes immediately outside of the building.

Intent of the process

**This is a high priority staffing process and will proceed quickly. We expect to initiate appointments for multiple positions by the end of the calendar year.**

A pool of candidates will be established and may be used to staff similar positions within the RCMP in the National Capital Region on an indeterminate or specified period (including term, acting, secondment or assignment) basis, with various linguistic profiles and various RCMP security clearances.

Should a Civilian Member (CM) be found qualified and selected for appointment, the appointment will not result in a change of status to the Public Service (PS) category for the CM. Information regarding the CM appointment will be sent to all applicable candidates who are within the area of selection and participated in the advertised process.

Should a Public Service (PS) employee be found qualified and selected for appointment, notification regarding the PS appointment will be posted accordingly on www.jobs.gc.ca.

In order to be considered, your application must clearly explain how you meet the following (essential qualifications)

Graduation from a school of law recognized by the law society of any province orterritory or the Chambre des notaires du Québec. (JD/LL.B/B.C.L./LL.L.).

Degree equivalency

Significant experience* in:
(a) providing legal advice on complex* issues in the areas of constitutional, administrative, employment and/or Crown law; OR
(b) presenting cases before an administrative tribunal or court of law; OR
(c) serving as a decision-maker in an administrative tribunal or court of law;

OR an acceptable combination of significant experience in (a), (b) or (c), as set out above.


NOTE:

* Significant experience is defined as the depth and breadth of experience normally acquired, as a member of law society of any province or territory or the Chambre des notaires du Québec, with having directly performed the functions as their primary duties, on a continuous basis for approximately three (3) years within the last five (5) years.

**Complex is defined as involving multiple competing issues raised in a delicate or highly sensitive context, involving multiple parties, or dealing with novel questions of law.

Experience working within a police force as:
a) A police officer; OR
b) Within the professional standards regime of a police force.

Experience as an administrative decision-maker in an employment or labour law context.

Experience with one or more of the following legislated processes within a police organization context: grievances; appeals of internal administrative decisions; RCMP conduct or other police disciplinary process; or violence and harassment in the workplace.

Experience mentoring administrative decision-makers or legal advisors.
